Terms of Service

These Terms of Service ("Terms") govern your use of the health-care application "Wellsy" ("Service") operated by YUKI SATO (sole proprietor, "Operator"). By installing or using the Service you agree to these Terms.

1. Definitions

  1. "Service": the Wellsy mobile app, Cloud Functions, push notifications, website, and related services.
  2. "User": any individual who creates an account and agrees to these Terms.
  3. "User Content": food photos, profile pictures, selfie photos, text, and any other content you submit.
  4. "Group Feature": functionality allowing users to form groups and share health data.
  5. "AI Feature": food image/text analysis via OpenAI API called through Cloud Functions (asia-northeast1).
  6. "ML Kit OCR": Google's on-device OCR for reading nutrition labels (no external server calls).
  7. "Health Data": food logs, weight, body fat, sleep records, and related health information.
  8. "Premium Service": paid subscription features planned for the future (not yet available).

2. Eligibility

  1. You must be at least 13 years old to use the Service.
  2. Users under 18 require parental/guardian consent.
  3. US residents: users under 13 are prohibited under COPPA.
  4. EU/EEA residents: users under 16 (or 13 in some member states) require parental consent.
  5. Korean residents: users under 14 may not use the Service.

3. Account Registration

  1. Sign-in methods (all via Firebase Authentication): Apple Sign In, Google Sign In, Email/Password.
  2. You represent that all registration information is accurate, current, and complete.
  3. We may refuse registration if you previously violated these Terms, provided false information, or do not meet age requirements.
  4. Keep your credentials confidential. Do not share, lend, or transfer them.
  5. Report unauthorised access immediately to wellsy.support@gmail.com.
  6. Creating multiple accounts for the same person is generally prohibited.

4. Service Features

  • Food logging (including AI analysis and ML Kit OCR for nutrition labels)
  • Weight and body fat tracking with graphs
  • Sleep logging and analysis
  • Group creation, joining, and health-data sharing
  • Comments, reactions, and selfie reactions within groups
  • Content reporting and user blocking
  • Streak (continuous logging) tracking
  • Push and local notification reminders
  • Premium features (planned for the future)

Backend: Google Firebase (project ID: wellsy-53ae4, Cloud Functions: asia-northeast1).

5. AI Feature – Disclaimer

  1. The AI food analysis sends your food photo or text to OpenAI, Inc. (USA) via Cloud Functions.
  2. Usage limits: 2 analyses/day (free); 10/day planned for premium.
  3. Results are estimates. Accuracy is not guaranteed.
  4. AI output is for informational purposes only — not medical advice.
  5. Downtime or changes by OpenAI may temporarily affect availability; Operator is not liable.

6. Health Information Disclaimer

  1. The Service is a health-management aid, not a substitute for medical care or diagnosis.
  2. Consult a doctor, dietitian, or health professional before making dietary or health decisions.
  3. The Operator is not liable for health issues arising from actions taken based on Service output.

7. Group Feature

  1. Join via a 6-character invite code. Max 20 members per group.
  2. Free plan: up to 3 groups. Premium: unlimited (planned).
  3. Group posts are automatically deleted 24 hours after posting (via Cloud Functions).
  4. Comments: max 100 characters, max 30 per post.
  5. Reactions: 5 types; optional selfie photo attachment.
  6. Post authors may delete their own posts.
  7. By joining a group you consent to your display name, profile picture, and activity status being visible to members.
  8. You may report inappropriate content or block other users.
  9. Operator may remove content, remove members, or dissolve groups if violations are found.

8. User Content & Licence

  1. You represent that your content is lawful and does not infringe third-party rights.
  2. You retain ownership of your User Content.
  3. You grant Operator a worldwide, non-exclusive, royalty-free licence to use your content solely to provide and improve the Service.
  4. This licence terminates when your account and content are deleted.
  5. Do not copy, redistribute, or repurpose other users' content beyond normal Service use.

9. Prohibited Conduct

  1. Violating applicable laws or public order
  2. Infringing intellectual property, privacy, or other rights of the Operator or third parties
  3. Impersonating another user or submitting false information
  4. Unauthorised access, reverse engineering, or tampering with the Service
  5. Disrupting Service operations (e.g., excessive requests, DDoS)
  6. Spam or unsolicited messaging
  7. Harassment, threats, or discriminatory conduct toward other users
  8. Uploading or sharing another person's photo or video without their consent
  9. Abusing the report feature (repeatedly submitting false reports)
  10. Illegal activity (drug sales, fraud, MLM, etc.)
  11. Posting discriminatory, defamatory, violent, or sexually explicit content
  12. Commercial use of the Service without prior written consent from the Operator
  13. Any other conduct the Operator reasonably deems inappropriate

10. Intellectual Property

  1. All intellectual property in the Service (code, design, trademark "Wellsy", etc.) belongs to the Operator or its licensors.
  2. You may not copy, modify, distribute, or sell Service content without prior written consent.
  3. Feedback you provide may be used by Operator without compensation.

11. Premium Billing

  1. Wellsy may use RevenueCat to manage subscription status and purchases. Actual payments are processed by the Apple App Store or Google Play.
  2. Any changes to billing terms will be announced and these Terms updated in advance.

12. Privacy

Your personal data is handled according to our Privacy Policy (https://wellsy.app/en/privacy), which forms part of these Terms.

13. Disclaimers

  1. The Service is provided "as is" without warranties of fitness for purpose, accuracy, or availability.
  2. Operator is not liable (except for wilful misconduct or gross negligence) for Service interruptions, data loss, third-party attacks, or inaccurate AI output.
  3. Operator is not responsible for disputes between users.

14. Limitation of Liability

  1. Operator's maximum aggregate liability for Service-related claims is the total fees you paid in the 3 months preceding the incident. While the Service is free, the cap is JPY 1,000.
  2. Mandatory consumer protection rights are not affected.
  3. Applicable mandatory laws may override this section for users outside Japan.

15. Service Changes & Termination

  1. Material changes will be notified at least 14 days in advance (30 days for adverse changes).
  2. Operator may suspend the Service for maintenance, security, or force majeure without prior notice.
  3. Operator will provide at least 30 days' notice before shutting down the Service.

16. Account Suspension & Termination

  1. Operator may suspend or permanently ban accounts for violations of these Terms, fraudulent activity, or other reasonable grounds.
  2. To appeal a suspension, contact wellsy.support@gmail.com.

17. Account Deletion

  1. To delete your account: in-app Profile → Settings → Account → Delete Account, or email wellsy.support@gmail.com.
  2. Deletion triggers Cloud Functions (deleteUserData) to remove your Firebase data.
  3. Deleted data cannot be recovered.
  4. Delete your group posts/comments before deleting your account if desired.
  5. Cancel any future premium subscription before deleting your account.

18. Governing Law & Jurisdiction

  1. These Terms are governed by the laws of Japan.
  2. Disputes will first be resolved through good-faith negotiation.
  3. Unresolved disputes will be submitted to the exclusive jurisdiction of the Tokyo District Court.
  4. EU/EEA residents retain rights under applicable EU mandatory consumer-protection laws.
  5. Korean residents retain rights under applicable Korean mandatory laws.
